My wife used Johnson and Johnson baby powder since she was a child. She used it for the first 20 some years of our marriage. The smell of it always reminds me of her.

In 1997 she was diagnosed with Ovarian cancer. Stage 1. The doctor at that time did the normal surgery. Despite being totally encapsulated, he took everything, both ovary's, cervix and uterus. Messed up the vagina as well. Subsequent surgeries by an oncologists repaired most of the damage. But had her in hospital for several years. 25 years later she has shown no signs of cancer. Last fall she was tested to see if she had any DNA faults that might lead to spontaneous Cancers. She has none!

She has not had multiple partners, she doesn't smoke or drink. According to the medical opinion, she should never have had the cancer.

She, and I for that matter, have suffered for that whole time. Worry about a recurrence. Constant medical monitoring. And Sex? it was out of the question.

So, she contacted one of those phone advertisements for legal help. That one went no where. Years later she tried again with another firm. And last week, after stringing her along for a year, they claimed her case, perfect as it was, was too old. I had no idea such had a statute of limitations.

I'm shocked. And bewildered.

It's not the money . By the time these charlatans got a settlement they took 40 to 60%. She had a PERFECT CASE! She should never have contracted the cancer but for an outside influence.

So my question is, should we even try again?

She says no, I say hell yes.

If the ambulance chasers can't see a relatively quick judicial decision on a case they don't want it.

I'm no lawyer and have no advice on that situation, but I can say that corn starch is a very effective replacement for talc powder.

What are your wife's reasons for saying no?
The constant reminder of her ordeal as she researches and finds medical records and files affidavits.

Twice now, she has provided very personal information to law firms who told her she had a case, a good solid one. One just evaporated. We never heard from them. The second also claimed her case was solid. Now it claims the case is too old.

How can it be "too old?" And if it is, why would trying again be worth doing.

Sounds like she is just ready to put this behind her and move on. Since it's not a money related thing, my vote is to do it her way.

And today she admitted she wasn't either. So she will be calling another law firm but getting the facts done up front.

Cee, I am, we are monogamous. For 53 years. That means more than half of our marriage was friends without benefits. In 1997, the first surgeon messed her up bad. The consequential and multiple repair surgeries of her Intestines, and kidneys lasted for three years. The scar tissue in her vagina was deemed unrepairable. The trauma induced IA (Intimacy Anorexia.)

She recently got over that with some therapy. We are again conjecal. But there was a cost, emotional and monetary. Over 25 years of living with the sexies' woman I have ever known and not able to touch her.

I love this woman. Completely and without deviation from our vows. The cancer cost us considerable pain and stress.


J&J knew they were selling a carcinogenic product. And unlike cigarettes, there were no warning labels about it's use for 40 years whilst people still foolishly indulged their pleasures and then paid the price. Hell they still advertised on TV where cigarettes were banned.

You suggested on another thread I am angry. I wasn't on that subject. I am lividly pissed on this one.

Ok, so that's her choice. I like that she has made that decision on her own and decided that she can deal with the "constant reminder." I get that you two are a very loving couple and have been through some very difficult times. I hope the legal battle is not too stressful for either of you and goes in your favor.

Maybe these Google search results might help.
Lot of lawyer links, so be careful.
Statute of limitations might be based on state level - where you live, or maybe where the original case is filed.

My surgery just about killed me, but they got me back.
I still have PTSD about that nasty crap.
