Court Rules for Administration on Obamacare, Upholds Subsidies

Posted on June 25, 2015, 10:13 am by Keith Koffler • 11 Comments

By a 6-3 decision, the Supreme Court Thursday announced that those who get health insurance through federal exchanges will be eligible for tax subsidies. Chief Justice Roberts wrote the majority opinion for the Court, affirming the decision of the Fourth Circuit in the case of King v. Burwell.

Roberts wrote:

In this instance, the context and structure of the act compel us to depart from what would otherwise be the most natural reading of the pertinent statutory phrase . . . Congress passed the Affordable Care Act to improve health insurance markets, not to destroy them. If at all possible, we must interpret the act in a way that is consistent with the former, and avoids the latter.

oops ... I started a thread "Established By The State":

____________________________

Legislating from the bench, the Supreme Court struck down 6 to 3 the challenge to Obamacare, in that only exchanges "established by the state" can provide healthcare insurance subsidies. Well, the GOP's stooped lawyers failed to include the architect of Obamacare, Jonathan Gruber, own words in their legal brief to the Court. Here it is:

The pertinent passage starts around 31:20 thru 32:20

How can the be so stoopid?

Not at all doc, like you I knew Roberts wasn't going to let obamacare die, after all he is the one that breathed life into it early on.

The SC has been screwing this country over for a while now and I look for it to get worse.

The next big ruling will be on gay marriage and you will see the SC rule in favor with the only three conservatives voting against it.

Roberts is making sure his adopted Irish babies wont be subject to a legal battle by Ireland.

His opinion reads like something Elena Kagan wrote
