Toxic Chinese Drywall Has Major Affect On A/C Industry, Homeowners And Associations

United States of America (Press Release) January 14, 2009 -- Statewide, Florida – In light of growing reports regarding defective “Chinese Drywall” installed throughout Florida primarily during the building boom of 2002-2006, homeowners, community associations and now air conditioning vendors must be aware of the potential health risks and financial liability linked to the allegedly toxic material.

Cheap drywall was imported from China during the building boom of 2002 to 2006. This type of drywall has been reported to emit sulfur dioxide when exposed to moisture. So called “Chinese Drywall” is believed to be the cause of increasing reports of noxious odors, thought to be from high levels of sulfur emissions coming from the drywall. Homeowners are also complaining of frequent, unexplained headaches, and other physical effects that are a growing source of concern.

“Industry professionals should be aware of this issue since one warning sign that high levels of sulfur are present is the "blackened" appearance of copper pipes in some air conditioning units,” said Donna Berger, Executive Director of the Community Advocacy Network (CAN) and Managing Partner of Katzman Garfinkel Rosenbaum in Fort Lauderdale. “In this instance, some consumers may think the problem lies with the air conditioning pipes when, in fact, the problem is stemming from the drywall in the residence.”

CAN, a statewide not-for-profit organization that represents the interests of more than 1,000 community associations (and the hundreds of thousands of residents living in those communities), has been educating vendors, homeowners and associations on the health risks, as well as possible litigation associated with Chinese Drywall through email alerts, articles and web posts.

In addition to the health risks, recovering losses associated with the removal and replacement of defective drywall is also a problem, as many builders and developers are filing for bankruptcy protection or closing their doors. As a result, delaying action until the problem has been resolved may result in frustrated homeowners that have little to no recourse against the builders that installed the defective materials or the suppliers that provided them with it.

“Homeowners associations and developers could face significant construction defect and product liabilities suits because of these hazardous materials,” said Dan Rosenbaum, Founding Partner of Katzman Garfinkel Rosenbaum in West Palm Beach. “Accordingly, owners and boards with concerns would be well advised to take immediate action.”

Residents who may be affected include those living in homes built between 2002 and 2007, where drywall imported during the 2004 to 2005 construction boom was used. Developers that have been identified as possible users of this drywall include Lennar Homes, Centerline, Tousa and Engel Homes.

Now we will have to install a sulfur detector.
The government lets those products in to this country.
Release these products and let the Americans test them?

Exactly, Vin. Less government getting in the way of the American Dry Wall industry would have negated the need to import this poisoned crap, from a hostile foreign entity.

There was not a need to import this drywall product. There was greed as a will and a need. It was another opportunity to cut costs and increase profits. Plus it allows unscrupulous contractors to underbid reputable contractors who refuse to use such garbage.
